Lorry driver jailed, caned for raping own daughter

KLANG: A lorry driver was today sentenced to 10 years in jail and 20 lashes of the rotan by the Sessions Court after pleading guilty to raping his biological daughter twice.
He was charged with raping his daughter, who was then aged 10 and 11, at 3pm on November 10 last year and 7am on May 17 this year at a house in Meru, Klang.
For each charge, he was sentenced to 10 years in jail.
Judge Siti Aminah Ghazali imposed the sentence on the 37-year-old father after he admitted to two rape charges and ordered the jail sentence to run concurrently from the date of his arrest on June 14.
She also ordered the father to undergo counselling and be put under police surveillance for two years after serving the sentence.
The charge under Section 376(3) of the Penal Code provides a jail term of up to 30 years and not less than 10 strokes of the rotan.
The man had committed the act on the girl, as someone entrusted with her care as a biological father, whose relationship to him is such that he is not permitted under the law, religion, custom, or usage to marry her.
The father, who did not have legal representation, pleaded for leniency, citing that he is supporting two children and his wife.
"I am remorseful and repentant. I will never do it again and I will change for the better.
"I hope the court hears my plea and gives me a low sentence," he said.
However, deputy public prosecutor Nuruljannah Aimi asked the court to mete out a heavy penalty as a father should be protecting his children and not betray them.
She said sexual crimes against children in the state were serious and their rampancy should not be tolerated.
"The accused is the victim's biological father entrusted to care for and raise her.
"But he turned the tables on her with such a heinous act.
"The court must consider that this traumatic incident will haunt the victim for the rest of her life," she said.
She had also requested for the father to be counselled and placed under police surveillance.
